The City of Portland passed a new law that will affect every business that has at least one employee doing work in the city of Portland.
The ordinance passed on March 13, 2013 states:
“Ordinance No. 185926 (as amended) authorize changes to the City Code to require Protected Sick Time for employees of businesses working in the City of Portland and enter into a contract with Oregon State Bureau of Labor and Industries for enforcement.”
This law goes effect on January 1, 2014 and will be enforced, with severe penalties for non-compliance, by the Bureau of Labor and Industries. Even if your business is NOT in Portland, you may be liable. With our Human Resource Services in Portland we will be able to answer any questions or concerns you may have. The penalties for non-compliance are severe. The BOLI Commissioner (currently Brad Avakian) may assess civil penalties for violation of the Ordinance. The penalties may be up to three times the dollar amount of Sick Time the Employee was refused, or $250, whichever is greater. For example, one minimum wage employee who files a complaint and wins, could cost you $250 – plus attorney fees.
- Provide guidance on meeting plan requirements
- Calculate the sick time accrual for each employee each payroll
- Provide the required notification for each employee of accrued time
- Determine the carryover amounts for each employee at year-end.
- Provide audit trail in case of BOLI inquiry
